The relationship between laws and regulations within the Party and national laws is an unavoidable problem in theory and practice.In our country,the national law is the unity of the Party’s proposition and the people’s will.The Constitution of the People’s Republic of China affirms the leadership of the Party,and stipulates that all political parties should take the Constitution as the criterion of their activities and have the duty to safeguard the dignity of the Constitution and ensure its implementation.The Communist Party of China is the ruling party of our country.To comprehensively promote the rule of law requires the Party to adhere to the rule of law,to lead legislation,to abide by the law,to ensure law enforcement,and to play a leading role in overall situation and coordinating all parties.Only by governing the Party according to rules and regulations can we reach the hearts of the people.Studying the formation and development of inner-party laws and regulations and exploring the relationship between inner-party laws and national laws are the key steps to build a country ruled by law.The Party Constitution is the fundamental law of the Party and the Constitution is the fundamental law of the country.Through the comparative study and analysis of some Party Constitutions and the text of the Constitution,we can see the relationship between the Party Constitution and the Constitution,the consistency of the fundamental value orientation and so on.From this,we can see that there is a cohesive,coordinated and complementary relationship between the Party’s internal laws and the national laws,and that the application scope of the Party’s internal laws and the national laws is partly overlapping,and this interaction is deepening day by day;but there are also inconsistencies between the two,and there is a lack of positive interaction.The difference between such internal laws and the national laws is not conducive to the rule of law,the government ruled by law,and the law.Integrative construction of governing society.The inner-party laws and regulations are the institutional basis and guarantee for the Party to govern the Party,aiming at restraining and regulating Party members and Party organizations,so that the Party can better serve the people;the national laws are the basis and guarantee for the construction of socialist rule of law,and also for the sake of better people’s lives,more happiness and a sense of acquisition.It is in this sense that the will of the Party,the state and the people is unified.In practice,inorder to achieve better coherence and coordination between the Party’s internallaws and national laws,we should adhere to the principle that the Party’s internal laws and regulations should not conflict with national laws,that the Party’s internal laws and regulations are stricter than national laws and that mature Party laws and regulations should be upgraded to national laws and other benign interaction principles in a timely manner.Only by properly dealing with the relationship between the laws and regulations within the Party and the laws of the state can we achieve the perfect cohesion and coordination between the two and promote the formation of a joint effort to help the construction of the socialist legal system with Chinese characteristics. |
