Research On The Protection Of Good Samaritan Legislation In China

Good Samaritan for a just cause is a kind of good quality with higher requirements for morality on the basis of helping others.Nowadays,with the rapid development of society,there are a lot of controversial cases and hot social events due to the imperfection of relevant legislation.The main reasons are as follows: on the one hand,the development of rumor obscures the light of law because the provisions of law are not explicit enough;on the other hand,the existence of multiple standards for the courage to do justice in China limits the protection of the righteous.Therefore,it is imperative to carry out unified legislation for brave acts,so as to safeguard the legitimate rights and interests of brave acts.In addition to the introduction and conclusion,the thesis consists of four parts:The first part is an overview of the courage to do justice.Through the elaboration of brave acts and various academic views of Chinese scholars,combined with the provisions of local regulations on brave acts,the relevant concepts and legal responsibilities of brave acts are clarified.The second part is about the introduction of domestic and foreign legislative status,through a comprehensive analysis and elaboration,it analyzes the shortcomings of the current legislation of courageous acts of justice in China,the department law,a series of social security law and local legislation have advantages and disadvantages,but it is difficult to apply them uniformly.Therefore,it is necessary for China to understand the legislative background and successful experience of foreign countries.The third part is to elaborate the necessity and feasibility of legislation in China.From the perspective of legal theory,social practice and legislative principles,this paper analyzes the necessity of legislation,and discusses the feasibility of legislation through the analysis of China’s current basic national conditions and the combing of favorable conditions.With the continuous improvement of the comprehensive strength of the country,the realization of the legislation of courage for good will be more guaranteed.The fourth part deals with the specific suggestions for the legislation of brave acts,starting with two parts: the general part and the specific provisions.In the general part,the legal nature and the legislative principles of the legislation of brave acts are clarified.In the specific part,the recognition of the legal concept,the reward and protection measures,the legal responsibility and other specific provisions are involved,which are committed to the implementation of the legislation of brave acts and the rights and interests of the brave acts.It can also be supported and guaranteed in place.
