Study On Problems Of Peasants’ Rights In The Protection Of New Plant Varieties

With the development of the new plant variety protection system,farmers’ rights and interests are increasingly being hit by it.The status of farmers’ rights in the system of new plant variety protection is very important.However,the subject of farmers’ rights and the details in the system of the new plant variety protection at home and abroad are still vague.At present,as a large country with rich plant genetic resources,neglect of rights can seriously threaten our country’s food security and social stability.Under such environment,the in-depth and systematic study on the protection system of China’s new plant variety will be of great help to further improve the farmers’ rights in the protection system and it’s also useful to establish the future development direction of China’s new plant variety protection system.It can help us to focus on promoting China’s agricultural science and technology innovation,and win the initiative in international trade of agricultural products to effectively build our germplasm resources protection.In order to ensure the sustainable development of agriculture and the protection of national economic security has important significance.This paper defines the existing theories both at home and abroad,and discusses the types of rights that farmers should enjoy under the protection system of the new plant variety protection system,balancing the conflicts of interests between farmers and breeders,and perfecting the relevant laws in China,and this paper will be divided into five parts for discussion :The first chapter mainly introduces the background significance,research ideas and innovations,laying a theoretical foundation for the dissertation,which is the starting point of this thesis.The second chapter elaborates the basic concepts of peasant rights,introduces its basic meaning and general situation of international legislation,clarifies the academic definition of related concepts in current theory,and points out the direction for subsequent discussion.According to the current legal provisions in China,the third chapter summarizes two major problems existing in the establishment of farmers’ rights: how to define the scope of farmers,how to set the content of the rights,and the difficulties they face,and then move toward fullscale theoretical discussions to solve problems.Thinking on the basic practical issues of the topic problem.The fourth chapter defines the scope of the main peasants,analyzes the current situation of major agricultural production entities,takes the production scale,production purposes and other factors as reference items,and uses four dimensions to define the peasant scope.In order to further clarify the protection system for new plant varieties.The object of the object provides a reference.The fifth chapter analyzes the object to be protected by the peasants’ rights,sets the content of the rights according to the object,and elaborates the rationality,feasibility and science of setting the right type.
