The territory of a country has long been unable to withstand the rapid development of globalization brought about by the environment,health and other global public crisis.At the beginning of 2020,In early 2020,the global outbreak of COVID-19 was described as the most significant global public crisis since World War II.The epidemic continues to increase the uncertainty of the global economy,and the imbalance of global development is further highlighted.The willingness of developed countries to participate in international affairs will also be further weakened.Globalization is facing profound changes.This has prompted people to reflect on the governance of global public health security.In particular,the legal system of international cooperation in Public Health has failed in the global epidemic prevention and control,and countries are divided in their cross-border co-ordination.Existing the International Cooperation Mechanism in Public Health based on the World Health Organization under the international health regulations(2005)as the core,the content including the public health events of international concern of monitoring and reporting system,public emergency treatment mechanism and international cooperation and assistance obligations,for global public health governance has played an important role.In the fields of international trade and international human rights,there are also coordinated norms in the field of public health.The legal mechanism of international cooperation in public health has encountered difficulties in practice,which is closely related to the rapid development of globalization.Based on the international trade system,the market-oriented reform of public health and the relevant provisions of the World Trade Organization,this paper analyzes the reasons for the failure of the existing legal mechanism of international cooperation: First,in the process of globalization,the developed countries in the high-end industrial chain gradually eliminated the manufacturing industry with low added value,which made it difficult for them to meet the demand for large-scale medical treatment and daily necessities when a major public health crisis broke out in the country.The phenomenon of resource run was serious.Second,the market-oriented reform in the field of public health has reduced the number of medical institutions and medical staff in some countries,which makes it difficult to provide effective public functions for the society when the public crisis breaks out.Third,as the most successful multilateral trade organization in the field of international trade,WTO has set up many legal provisions to maintain the balance between international trade and public health,but it has also brought problems of access to vaccines and medicines to developing countries.In addition,the legal mechanism of international cooperation to safeguard global public health security is unable to solve these problems due to its own defects.Based on the above analysis,this paper puts forward several suggestions for improvement: First,the IHR(2005)should establish and improve effective monitoring mechanisms and dispute resolution mechanisms to remedy the natural deficiencies of international law.Second,we should elaborate the ways and contents of international cooperation,solve the problem of medical supply and strengthen the cooperation with other international organizations.Third,attention should be paid to vaccine distribution and access to medicines in developing countries.Fourth,we should continue to exercise the authority of the World Health Organization,for example,by trying to solve financial problems,avoiding distractions,and at the same time improving the global health governance capacity of the World Health Organization.In response to the public health crisis,China has played a leading role and actively participated in international cooperation.It had fulfilled its international assistance obligations and strengthened technical cooperation among states in the face of the difficult national war of resistance against the pandemic.In the future,China should further strengthen the domestic public health rule of law system,such as standardizing the subjects of the right to publish early warning information and elaborating precise prevention and control measures.The Belt and Road Platform can also be used to promote global public health governance.
