| The orderly development of market economy can not be separated from the regulation of social credit system,and the construction process of social credit system can not be separated from the perfection of credit punishment system.Since the reform and opening up,Chinese society has gradually changed from identity society to contract society,and the credit status of each subject has become a common concern of the society.Lack of credit has become a difficult problem in social governance,credit punishment system came into being.Credit disciplinary measures have not only been regularized,but also penetrated into all aspects of people’s life.Credit punishment system not only meets the needs of the modernization of national social governance ability and governance system,but also achieves obvious governance effect.Credit punishment refers to the system in which the administrative subject makes a series of administrative or supervisory disciplinary measures to the discredit behavior of the dishonest subject according to the relevant authority or authorization,so as to improve the integrity consciousness and credit level of the whole society.Of course,there are still some problems to be solved,such as insufficient legal basis,generalized application and fuzzy power boundary,so it is urgent to find the corresponding solutions.Through the literature research method,we can understand the current research situation of credit discipline system in the academic field and find out its own research direction and innovation points;through the historical analysis of the historical evolution of credit discipline,we can clarify the current legislative situation of credit discipline system in China,and find the gap between ought and ought;The analysis of the implementation of credit discipline can grasp the problems and reasons in its practice,and then explore the path of perfection;the stone of other mountains can attack jade.The United States,Germany and Japan are more developed in the system of credit discipline.Through comparative study,we can provide reference ideas for the construction of credit discipline system in our country: the credit law standard system of the United States is relatively perfect and the credit service industry is relatively developed,the legal standard level of the credit discipline system in Germany is higher and has constitutional basis,Japan attaches great importance to the legal construction of credit information disclosure and the protection of the rights and interests of dishonest people is relatively sound.Based on the practice of China’s domestic credit punishment system and the relevant foreign practical experience,China can make changes from the aspects of promoting the introduction of social credit law,perfecting the supporting mechanism of credit punishment,regulating the administrative discretion of credit punishment,and perfecting the mechanism of protecting the rights and interests of credit subjects. |
