In recent years,with the development of Internet technology and the popularization of Internet applications,people’s dependence on the Internet has continued to increase.While the application of 5G technology has provided more convenience to people’s lives,it has also caused many problems.Taking the online copyright industry as an example,5G technology relies on faster information dissemination speed and powerful network technology to intensify the trend of online copyright infringement,which not only expands the scope and influence of infringement,but also makes the infringement problem more concealed.As a special subject in network copyright infringement,5G network service providers are frequently disputed because of their responsibility.Different from general civil infringement,the infringement of the right of network communication is concealed,has high technical requirements,and involves multiple parties.Just like this,it is difficult to define the liability for infringement of the right of internet communication at the current time when the legal system is not sound.This not only hinders the rapid development of the internet copyright industry,but also severely dampens the enthusiasm of the majority of internet creators to innovate independently.From this perspective,it is necessary for my country to clarify the copyright infringement liability of network service providers,which has far-reaching practical significance for strengthening the construction of network infringement law,protecting the legitimate rights and interests of copyright owners,and accelerating the normative dissemination of works in the network environment.Based on this,under the current legal framework of our country,this article takes network service providers as the research object,starting from the three perspectives of direct infringement identification standards,infringement liability based on the "notification deletion" rule,and rule construction,and discusses in-depth and objectively Analyzed the copyright infringement liability of network service providers.The main contents are as follows:The first part is the theoretical basis.This section is based on the relationship between the Internet era and copyright infringement,and then proposes the network service provider as a special infringement subject,and further raises the basic issues of the type and method of copyright infringement of the network service provider as a whole.The second part is the judgment standard for direct infringement of Internet service providers.This part first analyzes the criteria for determining the direct copyright infringement responsibility of Internet service providers from a theoretical perspective.The main points of view are server standards and user perception standards.Further analysis with the emergence of deep link technology,the shortcomings of server standards are gradually revealed,and user perception standards also have the inevitable defect of subjectivity.In response to the above problems,it is proposed that the essence of the judgment criterion is to correctly define the act of providing.The third part is the indirect copyright infringement of Internet service providers.The focus of this section is on " notice/take-down Standard" This part first discusses its origins in the United States,and further shifts to the continuous expansion of my country’s applicable fields.Finally,it analyzes the legal doctrine of the new provisions of the Civil Code on " notice/take-down Standard".The fourth part is the construction of infringement rules for Internet service providers.On the basis of summarizing the foregoing chapters,this section elaborates on the progress of the current law.Finally,it discusses and puts forward issues such as the application of network infringement clauses after the promulgation of the "Civil Code" and the determination of the scope of Internet service providers.
