The Study On The Application Of The Sentencing Suggestion Of The Leniency System In Pleading Guilty

The system of leniency to those who plead guilty and plead guilty has been established in China for the first time since the revision of the criminal procedure,and has been gradually promoted throughout the country.In this system,the prosecutors office plays a vital role as the intermediate link between the Public Security Bureau and the judicial organ.In the process of applying the system of leniency to the guilty plea,the sentencing suggestion is to make clear what crime the suspect and the defendant have committed and what penalty they have committed.First of all,this paper makes a legal theory analysis of the unique value of sentencing recommendations in the whole system of leniency to those who confess their crimes,and analyzes the value of sentencing recommendations in the whole system While exploring the relevant value of sentencing recommendations themselves,we can also deeply see that there are still many problems waiting for us to solve in the current sentencing recommendations under the lenient framework of plea bargaining,for example,the argument between the determination of penalty and the range of penalty in sentencing recommendations,and the lack of the standard of property sentencing recommendations,etc.,in order to solve the above-mentioned problems,at last,the author discusses the adjustment and reform of the sentencing suggestion system in the future plea-guilty cases,which will provide the ideological impetus for the further improvement ofsentencing suggestionsystem.
