The Perfection Of Export Control System Of Dual-Use Items In China-Take The United States For Example

Export control is an important system established by a country to safeguard its national security and development interests.Each country carries out export control to maintain its military or economic competitive advantage.However,in recent years,on the one hand,the export of sensitive items and technologies has shown a more complex trend,and on the other hand,the complex changes in the international situation have greatly increased the difficulty of export control.In order to better carry out export control,China adopted the Export Control Law on December 1,2020,which improved the dual-use items export control system by raising the legislative level,marking that China has stepped into a new stage in the field of export control.However,in recent years,the research on dual-use items export control system in China mainly stays at the theoretical level,and there are few researches on the new law,so there is a lack of perfect supporting measures when the new law is implemented,and the dual-use items export control system needs to be improved urgently.This paper is divided into four chapters.The first chapter is an analysis of the basic theory of dual-use items export control system.Firstly,the relevant concepts of dual-use items export control system are defined,then the dual-use items export control system is explored from multiple perspectives,and finally the conflict and balance in the dual-use items export control system is discussed.Chapter two summarizes the current situation of export control system of dual-use items in China.From the legislative system,management system,acceded to the international treaty and multilateral mechanism three aspects to comb.The third chapter explores the practical difficulties and causes of the dual-use items export control system in China.The export control system of dual-use items in China is facing five difficulties,such as the difficulty of enterprise innovation,the difficulty of defining dual-use items for export enterprises,the difficulty of supervising technology export behavior,the high cost of applying for export license for enterprises,and the barriers for enterprises to export.By analyzing the causes behind,it can be found that China’s dual-use items export control system has problems in five aspects,such as legislative concept,definition of dual-use items,concept of "export",export license provisions and extraterritorial effect.The fourth chapter puts forward some suggestions for improving the dual-use items export control system in China.Based on the experience of the United States,this paper studies the legislative concept,the definition of dual-use items,the concept of "export",the provisions of export license and the extraterritorial effect of dual-use items,and analyzes the ways to improve China’s dual-use items export control system.
