Study On The Improvement Of The Application Path On Admission Of Guilty And Acceptance Of Punishment

There has been a long—standing constracdition between the number of cases and the number of cases in China’s judicial organs,serious shortage of judicial resources,backward construction of criminal procedure.To improve the efficiency of handling cases in judicial organs,optimizing the environment of criminal procedure,China has formulated and promulgated the leniency system of admission of guilty and acceptance of punishment.Leniency system of admission of guilty and acceptance of punishment as a major measure of criminal procedure reform,to implement the combination of leniency and strictness in Criminal Justice,reflecting the important content of the reform of the formal litigation system centered on trial,it has great value in the diversion of criminal cases,optimize the allocation of judicial resources,protecting the basic rights and interests of the person.This article from the connotation of confession and punishment,through the analysis of the advantages and results of the leniency procedure in other countries and regions,and use it,benefit to further develop and perfect the uniform of admission of guilty and acceptance of punishment in China.The situation of combining system in judicial practice,analyze the existing problems.Finally,it is suggested to integrate the provisions of leniency of confession in the existing criminal procedure law,further scientific division and leniency of confession,improving the supervision measures for the admission of guilty and acceptance of punishment,establish a mechanism to deal with the adverse effects of the parties,guarantee the external,inner economical value of modern criminal justice unified in the system of admission of guilty and acceptance of punishment,then make the criminal procedure more suitable for the judicial situation,better meet the needs of case handling.
