| Since China established the “one-family-one-house system” at the end of the last century,it has an important institutional value for stabilizing rural land relations and ensuring the basic housing interests of farmers.However,with the acceleration of the country’s urbanization process,more and more farmers are entering the cities,and the current situation of rural homesteads has changed.Especially today when the strategy of rural revitalization is implemented,all links from homestead application to transfer to recovery are all against the original situation.Some regulatory methods have put forward new requirements.The implementation of the “one-family-one-house system”must not only protect the housing interests of farmers,but also meet the needs of economic value.Therefore,the rural “ one-family-one-house system ” should be continuously given new connotations.This article is based on the direction of homestead reform and combined with the actual situation in the operation of the rural“one-family-one-house system” in my country.This article is divided into four parts:The first part analyzes the connotation and function of the rural“ one-family-one-house system ”,and determines the basic objects to be studied by expounding the most basic concepts of "one-family" and "one-house".This part also analyzes the existence value and significance of the one-household system.Since the land management law established the “ one-family-one-house system ” it has extremely high value for the stability of social order and the protection of people’s livelihood.The second part,this part mainly analyzes the problems in the operation of the“one-family-one-house system”in order to better determine the direction of reform and development.During the operation of the “one-family-one-house system”,problems such as inadequate legal regulations have emerged.Only by clarifying the problems can we provide direction for a perfect approach.The third part analyzes three typical provinces’ legal regulations in terms of application for the right to use,transfer of homesteads,and repossession of homesteads during the operation of the “ one-family-one-house system ” in three typical provinces,so as to better learn from the existing experience and serve as one.The development of the “one-family-one-house system” provides realistic ideas.The fourth part,after studying the basic reality of the “one-family-one-house system ” and clarifying the development direction,proposes the basic ways and methods to improve the “one-family-one-house system” in rural homesteads.This part mainly combines the existing homestead reform experience,combined with the problems raised in this article,and proposes targeted solutions.In order to better guarantee the rural homestead,the “one-family-one-house system” can not only play a role in social security,but also meet the economic needs of rural areas and farmers in the new era. |
