Investigation interview is an investigation measure to communicate with the informed masses,victims and suspects by way of inquiry to understand the basic situation of the case.Investigation and interview is the quickest way for the investigation department to know the case information and also the premise for other investigation measures to proceed smoothly.,but in China there is not enough for the study of the theory of the survey,the practice of the survey system,insufficient training survey the concrete operation of the lack of specification guidelines,basic to grass-roots police personal judgment and experience of collection information case,resulting in case information collection is not comprehensive and the problem such as victims or insider relationship not harmonious.From the perspective of comparative research on investigation interview between China and the United States,this paper holds the idea that a stone from another hill can attack a jade,draws on the scientific achievements of the police on investigation interview in the United States,and further enriches and improves the system regulations on investigation interview in China from the theoretical and practical perspectives.This paper is divided into six parts.The first part is the introduction,which briefly introduces and explains the background of topic selection,research methods and literature review.The second part compares the subject and legal basis of investigation and interview between China and the United States.Through the comparison of the regulations of investigation and interview between China and the United States,the selection of law enforcement personnel to carry out investigation and interview and the relevant legal requirements,it is found that there are differences between China and the United States in law enforcement tendency and the definition of the concept of interrogation and other aspects.The third part compares the implementation process of survey and interview between China and the United States,mainly focusing on the survey and interview objects,implementation methods,implementation strategies and other aspects.Through the research,it is found that there are great differences between China and the United States in the classification of visitors and the specific implementation methods of survey and interview.The fourth part is the differences between Chinese and American judicial organs in the acceptance and review of investigation and interview evidence.Because China and the United States have different criminal justice systems,criminal evidence rules and court prosecution and defense modes,and there are also different legal basis and application of evidence in the way of investigation and interview evidence recording and court application.The fifth part mainly compares the differences between Chinese and American survey and interview management.Through a comparative study on the selection and training of police investigators in China and the United States,it is found that there are differences in the skills training concept,training curriculum,training content design and training cycle of the personnel conducting investigation and interview between China and the United States.The sixth part optimizes the survey interviews in China by comparison.Based on the above research,this paper draws on the strengths of American police on investigation and interview,and combines the experience of Chinese investigation work,relevant psychological theories and new technical investigation techniques,and puts forward specific ideas on how to construct a scientific investigation and interview model. |
