The periodicity and complexity of the housing sale and purchase transaction have caused great troubles to the house transfer in practice,greatly impeded the process of the housing sale and purchase,and lengthened the transaction time.But in order to grasp the trading opportunity,in practice,both sides will generally sign an appointment contract to determine the relevant matters.it is relatively simple and only a rule of principle.At the present stage,the lives of the broad masses.The system assumed by the guarantee function,fixed trading opportunities,the role of making up the contract fault responsibility.Then,starting from the specific problems such as the imperfect provisions of compulsory performance in the system of the reservation contract of house sale and sale in China.briefly analyzes the damages caused by breach of reservation contract in judicial practice.About booking system this paper also draw lessons from foreign related theory,comparison and analysis of the system in force of law,the law of the latter and default that resulted from the difference between the rights protection,and then to summarize the situation of the system in China,in the end,think that should be recognized in the constitutive requirements,effectiveness,contract performance.
