| Socialism with Chinese characteristics has entered a new era,opportunities and challenges coexist.With the rapid development of economy and society,social contradictions and disputes also present a trend of frequent occurrence.Giving full play to the role of mediation can effectively deal with social conflicts and disputes,especially the social governance challenges brought about by grassroots civil disputes.The historical experience of more than half a century tells us that the "Fengqiao Experience",which integrates the eastern experience,has always been famous for resolving contradictions at the grassroots level.In particular,as one of the important contents of "Fengqiao Experience",Fengqiao civil mediation provides a lot of reference for the resolution of grass-roots civil disputes.From the central government to the local government,both the "Fengqiao Experience" and the civil mediation of Fengqiao are highly praised.The "Fengqiao Experience" is constantly used to mediate civil disputes in all parts of the country.In practice,many advanced experiences have been produced,and many problems and difficulties have been found.Only by drawing on advanced experience and putting forward solutions to solve problems can we better adhere to and develop the "Fengqiao Experience",and further promote the continuous improvement of grassroots civil dispute mediation mode,and contribute more to the modernization of grassroots social governance system and governance capacity.The first part of this paper is the introduction,which introduces the related background and research ideas.The second part is an overview of "Fengqiao Experience" and mediation system.It introduces the relevant contents of "Fengqiao Experience" and mediation system,and expounds the historical background,development process,concept and Enlightenment of "Fengqiao Experience",historical conditions of mediation system and practical significance of mediation.The third part is the feasibility analysis of putting "Fengqiao Experience" into grass-roots civil dispute mediation,introducing the internal relationship between "Fengqiao Experience" and mediation.The feasibility is analyzed from the following three aspects: the civil mediation motivation planted in "Fengqiao Experience" can be used for reference,the rich civil mediation practice in Fengqiao experience can be used for reference,and the promotion motivation and value of Fengqiao Experience itself Analysis and elaboration.The fourth part is the application of "Fengqiao Experience" in grass-roots civil dispute mediation.The author gives full play to his own advantages in the court system and combines with the actual investigation and research results,focusing on the analysis of three advanced representative models of "Fengqiao Experience" in Zhejiang courts,including Lishui court sub mediation mechanism reform,Putuo mode,Longshan experience,and makes relevant summary Conclusion and comment.The fifth part is the problems encountered in the application of "Fengqiao Experience" in grass-roots civil dispute mediation.It is found out that "Fengqiao Experience" faces new challenges under the new situation,multiple factors restrict the promotion and application of "Fengqiao Experience",and the long-term mechanism is not perfect,which is not conducive to the promotion of "Fengqiao Experience" and the development of grassroots civil dispute mediation.The third part is to put forward the "long-term experience" of "Fengqiao" to solve civil disputes To upgrade the "Fengqiao Experience",and to better promote the grassroots civil dispute mediation mode. |
