Worth further study.Based on pleaded guilty to forfeit their various interests and litigation in the elements of instability,go back on our word is inevitable,academic basic recognition go back on our word is accused of a right,but the lack of specific implementation measures,after go back on our word processing and relief operations around the chaos,has not yet set up the mechanism of institutionalized renege,lack of unified regulation of specific treatment,especially weak back relief,therefore,It is necessary to base on the national conditions of our country to study the related problems related to reverse relief.This paper is divided into four parts: introduction,text,conclusion and acknowledgement.In this paper,according to the status of the criminal procedure according to the accused person first then the victim on the relief mechanism of repentance of confession,according to the general idea of putting forward problems,analyzing problems and solving problems,the research object is divided into four chapters.The first chapter introduces the connotation and constitution of the repentance of confession and the legal basis for the relief of repentance of confession,which lays the foundation for the follow-up study.The second chapter introduces the provisions of the reversion relief in the negotiation procedure of foreign countries and Taiwan of China in order to provide some enlightenment for the construction of the refined reversion relief mechanism of confession penalty in China’s mainland.The third chapter analyzes the status quo of repentance relief for guilty plea in China,analyzes the judicial practice of repentance relief for guilty plea from the two aspects of the operation of repentance cases and the exploration of the causes of repentance,analyzes the problems existing in the judicial practice of repentance relief,and points out the practical dilemma of repentance relief.The fourth chapter from the early prevention mechanism,reducing the rate of regret to the later restraint mechanism,the treatment of the regret,to improve the punishment of guilt and regret relief mechanism put forward fine constructive measures.
