| At present,public emergencies often occur,which seriously endanger the lives and health of citizens,such as the sudden SARS incident in my country in 2003 and the H1N1 influenza in 2009.Response to emergencies is a major issue that any country must face.The response and handling of every emergency involves the restriction and protection of the basic rights of citizens.In December 2019,a new type of coronavirus pneumonia(ncp)broke out in Wuhan.The virus spread and broke out quickly.Governments at all levels have actively taken measures to restrict the personal freedom of citizens to control the epidemic.However,due to the urgency of the epidemic and the lack of legislation,there are also many problems with measures to restrict citizens’ personal freedom in the process of epidemic prevention and control.Therefore,it is necessary to study the restrictions on citizens’ personal freedom in the prevention and control of the epidemic,and to make corresponding improvements to the problems,so as to provide references for the prevention and control of public emergencies in my country in the future.This article includes four chapters.The first chapter starts with three examples of restrictions on citizens’ personal freedom in the prevention and control of the new crown epidemic,and proposes the constitutional issues involved in the examples,thus introducing the issues to be discussed in this article.The second chapter mainly analyzes the legal basis of restrictions on citizens’ personal freedom in epidemic prevention and control,and elaborates the legal basis and principles to be followed for restrictions on citizens’ personal freedom in epidemic prevention and control.In case of emergencies,in order to protect the rights of citizens,administrative powers are expanded and civil rights are restricted.However,the exercise of power is not arbitrary,and certain principles need to be followed.The third chapter analyzes the problems existing in the restriction of citizens’ personal freedom in the prevention and control of the epidemic.my country has responded to the epidemic in various ways,but there are also many problems in these measures,such as the imperfect legal system in public health emergencies,and the excessive authority of administrative agencies.The fourth chapter is mainly to provide suggestions for the problems that exist when the personal freedom of citizens is restricted in the prevention and control of the epidemic.At present,there is still a lot of room for improvement in the research on the restrictions and guarantees of citizens’ personal freedom in the prevention and control of the epidemic in our country.Therefore,it is necessary to combine the current situation of our country and grasp the actual problems from the actual situation.The shortcomings in the process of restricting the personal freedom of citizens in my country have perfected the protection of citizens’ rights in the prevention and control of the epidemic. |
