Research On Risk Assessment Procedures Of Major Administrative Decisions

The uncertainty and mobility of the whole world are getting stronger and stronger,leading to the risk of the society is becoming more and more obvious.When the society enters the risk society,it is more necessary to pay attention to the risk assessment when making major administrative decisions.Timely and accurate risk assessment by administrative organs can prevent and control the occurrence of risks in advance,which is also conducive to the introduction and implementation of major administrative decisions.However,in practice,in the process of risk assessment for major administrative decisions,the risk assessment process cannot truly reflect its effectiveness due to the lack of a unified procedure system,the non-neutrality of assessment experts,the arbitrary selection of assessment methods,the non-disclosure of assessment information and the time limit of assessment.Based on the legislation and practice of the risk assessment procedure of major administrative decision,this paper analyzes the causes of the problems and puts forward some suggestions.That is,to establish a unified risk assessment procedure system for major administrative decisions,to construct a rational expert mechanism,to clarify the choice of assessment methods,to set up diversified assessment information disclosure channels,and to stipulate specific assessment time limit.In addition to the introduction and conclusion,this article is divided into four parts:The first part is the basic theory of risk assessment procedure for major administrative decision-making.This paper expounds the necessity and importance of risk assessment procedure in the process of major administrative decision-making through the concept,characteristics,legal basis and legal significance of risk assessment procedure.The second part,the basic requirements of risk assessment procedure for major administrative decisions.The risk assessment procedure of major administrative decision-making requires that the procedure is legal,fair and just,participatory and democratic,open to information,and efficient in operation.Based on the basic principle and system of the procedure,this paper further elaborates the principles and concepts that the risk assessment procedure of major administrative decision-making should carry out.The third part,the status quo and existing problems of major administrative decision-making risk assessment procedures.By analyzing the legislation status and practice of risk assessment procedures for major administrative decisions in China,this paper analyzes the existing problems,such as lack of unified procedure system,the appraiser is not neutral,arbitrary selection of assessment methods,non-disclosure of assessment information and unclear assessment time limit.The fourth part,the improvement measures of the risk assessment procedure of major administrative decision-making.In view of a series of problems existing in the current risk assessment procedure of major administrative decision-making,this paper puts forward some suggestions,such as formulating a unified risk assessment procedure system of major administrative decision-making,constructing rational expert mechanism,clarifying the choice of assessment methods,setting up diversified information disclosure channels,and stipulating specific assessment time limit.
