Study On The Legal Issues Of Government Information Disclosure From The Perspective Of Anti-corruption

On May 1st,2008,the Regulations of the People’s Republic of China on Government Information Disclosure came into effect,which promoted the legal level of government information disclosure in China.Government information disclosure plays an important role in the public’s timely access to information and improving the transparency of government work.However,with the continuous improvement of the requirements for the construction of a law-based government,government information disclosure also exposes some problems.For this reason,the regulations of the People’s Republic of China on the disclosure of government information was revised for the first time in 2019 and came into force on May 15 th,2019,at the same time,the research on the review of the system of government information disclosure has become a hot issue in the theoretical and practical circles.Many scholars focus on the positive impact of government information disclosure on anti-corruption and other related theoretical and practical issues.First of all,on the premise of clarifying the current legislative status of government information disclosure in China and the anti-corruption function of government information disclosure,this paper further studies the foreign legal system of government information disclosure related to anti-corruption,and gets the following enlightenment from the legislation of government information disclosure in the United States,Germany,the United Kingdom and Singapore: a complete system of government information disclosure restricts public power,a sound system of civil servants power transparent government construction,the flow of media channels to boost the public’s supervision,standardized procedures designed to prevent abuse administrative power,public administrative information safeguard social public participation;Secondly,through a comparative study,the paper explores the problems and reasons of the government information disclosure system in China: due to the constraints of history and culture,the government information disclosure system in China should be improved,The legislation of government information disclosure is relatively low,the government information disclosure lacks a strong guarantee mechanism,the government information disclosure regulations formulated by the State Council have not been fully implemented,and some local governments and their departments generally have the situation of selective disclosure of government information.For example,the government information disclosure platform is not perfect,the disclosure system is not perfect,and there is a gap in government decision-making,implementation,management,service and result disclosure.The contents of legal active disclosure are not comprehensive,the response to the application is not timely,the financial information is selectively disclosed,and the administrative decision-making information is not in place.The failure to disclose government information in accordance with the law resulted in some cases of corruption;Finally,this paper puts forward countermeasures from five aspects to improve the legal and regulatory system of government information disclosure in China from the perspective of anti-corruption: Firstly improve the legal and regulatory system to ensure that government information disclosure has laws to follow;Second,we will strengthen the building of a law-based government and ensure that government information disclosure has laws to abide by;Thirdly Public participation shall be guaranteed in accordance with the law to facilitate the exercise of the public’s right of supervision;Fourth,make government information public in accordance with the law,curb abuse of power and build a clean government;Fifth,guarantee the investment of government funds according to law and improve the scientific and technological level of government information disclosure.In short,through the above measures to improve our government information disclosure system,so that it can give full play to the anti-corruption system function,promote the current anti-corruption work in China.Power should be realized in a visible way.The government information disclosure system is conducive to standardizing the administrative behavior of administrative organs,promoting the transparency and openness of the administrative system,encouraging the public to participate in the power supervision,promoting the integrity and self-discipline of government staff,and thus preventing the growth of corruption.The publicity of government information gives full play to the function of anti-corruption system,which is of great significance to promote the current anti-corruption work in our country.Therefore,the research on the legal system of government information publicity from the perspective of anti-corruption should be paid attention to by the theoretical circles.
