The Study On The Subject Of The Exercise Of The Rights Of The Collective Property In Rural Areas

The collective member is the subject of ownership of collective property,but the number of members is so large,so the subject of right exercise is needed to exercise the ownership on behalf of it.Due to historical reasons,the functions of collective economic organizations and village committees are confused,the personnel are not divided,so the collective ownership has the risk of being emptied.Management power is an important part of ownership,which is necessary for the effective exercise of collective ownership.In order to effectively realize collective ownership,we must rely on the subject of right exercise.There is no doubt that a collective economic organization is an ideal subject to exercise its rights.However,the key to the problem lies in how to ensure the effective exercise of management rights by the collective members and how to regulate the subject to exercise its rights,rather than simply rebuilding an organization.In order to ensure the effective exercise of collective ownership,first of all,we should take legislation as the bottom line and allow the members of collective economic organizations to determine the criteria of membership.Only when the criteria are established,can the composition of personnel be determined.Secondly,we should clarify the original functional boundary between the village committee and the collective economic organization,clarify the functions and status of the collective economic organization,and recognize and improve the role of the village committee.Thirdly,any system is not perfect,which needs to respect the right of collective members to choose the right to exercise the main body and improve it accordingly.Finally,emerging organizations such as agricultural industry associations and specialized farmers’ cooperatives have emerged in rural areas,and the analysis of their relationship with the right to exercise the main body is conducive to better serve the rural economy and realize the integration ownership.
