| With the development of urbanization and the advancement of household registration reform,the farmer group has also undergone different degrees of differentiation.The large-scale idleness of land after farmers went to cities for work has seriously endangered our country’s farmland protection policies and national food security.for work,has seriously endangered our country’s farmland protection policy and national food security.In the confluence of comprehensively deepening reforms in the new era and realizing the strategy of rural revitalization,the reform of the rural land system and the reform of the collective property rights system have become the focus of reforms in the“three rural”problem.Among them,the voluntary and paid withdrawal of collective land rights by farmers who settle in cities is the most important thing.In the specific reform process,in addition to prudently and steadily advancing the content of the relevant land reform,it is also required that the reform exploration must have a sense of urgency for reform,improve the voluntary and paid withdrawal system of collective land rights for farmers who settle in cities,and fully respect the withdrawal of farmers’ willingness and local complex,and take good care of risks.Both farmers who meet the exit conditions are allowed to withdraw from collective land rights with compensation,and farmers who do not meet the exit conditions are allowed to continue to hold land rights during the transition period after entering the city.At the same time,exit thresholds must be set to prevent farmers irrationally withdraw from land rights.Regrettably,the “three rights” system of voluntary and paid withdrawal from collective land for farmers who settled in cities has not been perfected,and there is a lack of unified regulations at the micro-level operation level for this problem nationwide.Based on this,the main part of this article is divided into four chapters for research and analysis.The first chapter is the preliminary analysis of the issue of the withdrawal of the “three rights”of collective land.Starting from the analysis of the related concepts of the issue of the withdrawal of the “three rights” of collective land,I explain the importance of the membership of collective economic organizations in the issue of the withdrawal of the “ three rights ” of collective land,then analyze the practical significance and feasibility of the withdrawal of the“three rights” of farmers’ collective land in cities and settled down,which lays the foundation of the thesis research.The second chapter is existing regulations and local practices on the withdrawal of the“three rights ” of collective land.I list the relevant policies and regulations of the central and local governments on the voluntary and paid withdrawal of collective land rights for farmers who settle in cities.What’s more,based on the practical experiences of the authorization of the Rural Reform Pilot Area and the Standing Committee of the National People’s Congress Practical experience in pilot areas that postpone the implementation of relevant land laws and regulations,I summarize the effects of specific reform measures in some typical areas,which provide empirical references for future research.The third chapter is the problems in the withdrawal of the “three rights” of collective land.I analyze the theoretical and practical problems that occurred in the withdrawal of the “three rights ” of collective land after farmers settled in cities,and expose the changes in collective membership status and the “separation of the three rights”.The following issues include the unclear legal attributes of land rights,unreasonable compensation for land withdrawal,and factors affecting farmers’ voluntary and paid withdrawal from collective land rights.The fourth chapter is the improvement of the “three rights” withdrawal system of collective land.Based on our country’s national conditions,the basic principles that should be followed in the voluntary and paid withdrawal of the “three rights” of collective land for farmers who settle in cities are put forward.Aiming at the emergence of the “three rights” withdrawal of collective land,this thesis puts forward a series of specific suggestions to improve the voluntary and paid withdrawal system of the “three rights”of collective land for rural residents in cities in our country,which will contribute to the advancement of rural land reform,improve our country’s rural collective property rights system,and achieve the goals of promoting urbanization,ensuring food security,and revitalizing rural areas in an integrated manner. |
