The 21 st century is the era of information explosion,as well as the network era of rapid development,but also technology changing era,we recognize that the benefits of development to people,people are enjoying the benefits brought by information network era,but it is undeniable that in enjoying the network brings enormous benefits at the same time,also has given rise to many new crimes,The birth of Internet court,the existence of intellectual property court,and the situation that electronic evidence accounts for half of the evidence today also issue a challenge to us:how to enjoy the convenience brought by the Internet while avoiding the risk of the Internet is a problem that people need to think about.If not completely circumvent,then at least let the network technology become our means to protect the safety of people’s lives and property.In the era of increasing emphasis on evidence adjudication,electronic data is constantly changing with the development of the Internet,with more and more types and larger and larger volumes,which puts forward new requirements for the collection,identification and use of electronic data in criminal proceedings.In view of this,in order to effectively deal with the crime,this paper starts with the case to explain that the collection of evidence,authentication and cross-examination in criminal proceedings are the urgent problems involving electronic evidence.Only when these problems are properly solved,can criminals be punished in accordance with the law within the legal framework.From the Angle of fighting crime,this paper explores the connotation of electronic evidence authentication,draws on the experience of foreign countries,and reflects on the existing problems.The characteristics of Internet crimes are strong concealment,fast mobility and easy destruction of evidence,which increase the difficulty of police in investigating and collecting evidence and proving the facts of cases.The existing laws of our country are not perfect on the authentication of electronic evidence,so most electronic evidence is questioned due to the irregularity of authentication,thus losing the ability of evidence.On the research of the electronic evidence distinguishing problem,help to perfect our country existing legislation on electronic evidence distinguishing rules,to explore the practice of electronic evidence rules,better serve the evidence system,to ensure the judicial spirit,in order to ensure the security of people’s life and property,also more to crack down on illegal crime,the construction of a harmonious healthy and stable living environment.
