Research On Rural Justice In The Context Of A Comprehensive State Based On The Rule Of Law

Rural judicial work is not to be underestimated in the construction of law-based villages,is the key to the construction of law-based villages,but also an important cornerstone of comprehensively promoting the rule of law.Country judicial is actually smells of public power organizations according to law to solve rural activities of social disputes,academic field of specification defines the concept of the country,generalized the country judicial is not only including grass-roots court sent the court having jurisdiction or organization judicial mediation to resolve disputes,villagers also covers the village cadres and mastering to solve disputes,judicial offices management and guidance of the people’s conciliation committee organization in the people’s mediation,public security local police station of public security mediation,and other administrative organs and their various assigned station organization way of administrative mediation to resolve rural disputes.The 19 th National Congress of the Communist Party of China has made it clear that the country should still adhere to the comprehensive rule of law.Under the background of the new era,the weak areas of China’s rule of law construction are villages.Rural justice,as one of the ways to govern rural society and build modern villages,plays a significant role in promoting the process of rural modernization.Building law-based villages is also an indispensable part of comprehensively governing the country by law.This paper mainly discusses the basic theories of rural justice such as the application of law to solve disputes in rural grass-roots organizations and analyzes the current situation of rural justice,explores the problems existing in the practice of rural justice in China,and gives the corresponding optimization path.In addition to the introduction and conclusion,this paper is divided into four parts.The first part is the comprehensive rule of law and the concept of rural justice interpretation,divided into the comprehensive rule of law overview and the concept of rural justice interpretation of two sections,the first section respectively briefly discussed the comprehensive rule of law connotation,background,general objectives and content;The second section focuses on the semantic analysis of the relevant concepts of rural justice.First of all,the concept of rural justice is defined,and then several similar terms and the concept of rural judicial exercise subject are explained,and finally,the way or type of rural justice is compared;The third section is the logical connection between the rural justice and the rural construction under the rule of law.It mainly elaborates the mutual relationship between the rural justice and the rural construction under the rule of law and the importance of the rural legal environment to the rural judicial operation.The second part is the historical origin of rural justice.Starting from the two time dimensions of ancient times and the new democratic revolution,it shows the historical appearance of rural justice in different periods from ancient times to the present,and lists and sorts out the types and solutions of the conflicts and disputes mainly solved by the early rural justice.The third part detailed Syria obstacle to rural issues of justice,explains the factors restricting our country judicial operation includes the lack of the rule of law propaganda work,the villagers of the rule of law concept,analyzes existing limitations the rural areas,the judicial corruption and human justice in judicial injustice,country judicial staff team construction problems,and many other aspects.The fourth part is proposals to our country judicial offices problems,in the fourth part expounds problems put forward on how to strengthen the rule of law publicity and education,to guide the villagers to enhance consciousness of rule of law,strengthening the country judicial staff team construction,relationship between local rules and national laws,establish and improve the country judicial staff supervision mechanism of targeted optimization solution.
