Research On Jurisdiction Of The Crime Of Aggression In The International Criminal Court

At present,there are still many difficulties in the international community’s jurisdiction over the crime of aggression.Right of the cognizance of the international criminal court(ICC)with aggression,improve court independence and at the same time it brings certain challenges in the international political order,the concrete on the cognizance of aggression,two institutions for aggression that results if inconsistencies,on the one hand,will lead to a series of trial court follow-up procedures is limited,on the other hand may also impact on security council exercise functions and powers.The application of the ICC’s jurisdiction is also controversial,reflecting the reservations of many States regarding the Rome Statute and the amendments to the crime of aggression.Therefore,solving the problems in the jurisdiction of the crime of aggression is of great value to the development of the international criminal court.This paper will discuss from five parts.The first part is a preliminary explanation of the concepts related to the crime of aggression.First of all,through literature review,the course of the illegality of the war of aggression is clarified,and the relevant content of how the crime of aggression is defined in the Rome Statute is understood,which will pave the way for the rest of the paper.The second part clarifies the prerequisites for the jurisdiction of the crime of aggression the principle of state consent and the identification of the act of aggression.The third part mainly studies the jurisdiction mechanism of aggression crime.The fourth part mainly analyzes the main problems existing in the jurisdiction of the International Criminal Court for the crime of aggression.The fifth part puts forward the countermeasures to the question of the jurisdiction over the crime of aggression,and improves the Rome Statute and its jurisdiction mechanism from the concept of the community of human destiny.
