Online games can be technically divided into two parts,i.e.program code and game user interface.Among them,the program code should be protected as a computer software by the copyright law,and the current laws and regulations related to this topic have been developed for a long time and are relatively mature.Compared with the traditional single-player gaming,online gaming normally requires more than one player.Online-gaming also requires more equipment and character upgrades in order to beat other players,which of course,has to be paid.The money obtained by charging the players for the upgrades,bring huge profits to gaming industry.The huge profits also attract many online-gaming developers to copy the design of some well-known online games(e.g.League of Legends,Hearthstone,etc.)at great risk,which are considered as infringement of Intellectual Property Law.This thesis tries to take advantages of the advanced experience outside the country,through which several relevant copyright protection advices are given as well as some suggestions relating to the legal protection system for online gaming user interface copyright in China.The research mainly focuses on the scope and methods of online game protection and the methods of infringement identification,by adopting the "ideal and expression dichotomy" and "contact + substantive similarity" methods.This thesis work also analyzes and discusses some of the famous copyright infringement cases and proposes relevant legislative and judicial suggestions for the construction of online game copyright protection system.
