As a vulnerable group in the society,the rights of elderly need the efforts of all parties in the society,mainly including the cooperation between various mass autonomous organizations and pension institutions.More importantly,it needs the maintenance obligors to actively perform their maintenance obligations to ensure the elderly to enjoy their old age.The income gap between urban and rural residents also determines that the elderly in urban and rural areas will face different difficulties in their old age.In this paper,the author mainly analyzes the current situation of supporting the elderly in rural areas.We should concern that the elderly usually chooses family supporting in rural areas,because of limited income and traditiona.The supporting obligation is mainly borne by their children.There will be large and small conflicts between the rural elderly and their children.The supporting dispute in rural areas has both the general characteristics and some particularities.Therefore,the choice of solution should be made according to its own characteristics.However,the most important goal of all ways is to protect the rights of the elderly and promote family and social harmony.In real life,the settlement of rural support disputes mainly includes consultation,mediation,litigation,etc.one of the main lines of this paper is to analyze the operation status of the above-mentioned dispute resolution methods and put forward the problems pertinently.At the same time,how to scientifically and reasonably divide the maintenance obligations and what responsibilities the government and social organizations should bear in supporting the rural elderly are also one of the focuses of this paper.In this paper,the author puts forward his own suggestions after expounding and analyzing the operation status and existing problems of various procedures in reality.In addition to the introduction and conclusion,this paper mainly consists of three parts.The first part: the current situation of rural support and the types of disputes.The settlement of disputes must explore the causes of the formation of disputes.In this part,the author obtains the relevant data of the current situation of rural support and the types of disputes involved in a rural area of Shanxi Province through interviews with relevant people and questionnaires.Through the analysis of the above data and documents,the author summarizes the basic status of rural support and the types of disputes,and explores the reasons for the formation Make preparations for the subsequent dispute resolution and targeted improvement suggestions.The second part: the existing rural support dispute resolution mechanism and existing problems.This part of the information is mainly obtained by visiting the people’s mediation committee,the village committee and the township judiciary.It can be seen that the settlement mechanism of rural maintenance disputes is mainly divided into three ways: reconciliation,mediation and litigation.The application of these three ways in real life often has a certain order,and there are also some problems that need to be solved.Through the analysis of this part,it provides a reference for the following suggestions.The third part: the improvement suggestions for the above problems.On the basis of combing and analyzing the previous part,combined with the overseas experience of solving family disputes similar to maintenance disputes,this part puts forward some suggestions on improving the relevant legislation,establishing a court for the elderly,the spouse of the supporter attending the defendant,and the people’s mediation committee centered on restorative mediation.
