Research On The Reform Of The Application Scope Of Our Country’s Trial Organization

The civil adjudication organization of our country’s courts is the sole-appointment system and the collegiate system.After the founding of the People’s Republic of my country,the basic-level courts in China have maintained a legislative positioning of the collegiate system as the main and sole-appointment as the supplementary for a long time.It can guarantee the stability of our country’s legal system,but it will inevitably cause many contradictions with changing social life.The static development of legislation and the impact of changing social life are comprehensively reflected in the judicial process.In order to effectively adapt to the changes in social life,China’s court system has made various efforts on its own.In2020,a civil trial organization was officially launched.In the pilot reform of the adjustment of the scope of application,there are still problems in the application of civil trial organizations,such as confusion in the application of the trial organization,arbitrary conversion,and narrow application scope of the intermediate people’s court.The legal root is mainly due to the division of cases in the trial organization.Unreasonable standards,unclear standards for the conversion of a single-appointment system to a collegiate system,a narrow scope of application of the single-appointment system,and unclear attribution of the collegiate panel have a combined effect.Therefore,the application of civil adjudication organizations in our country should be further improved on the basis of reform.The case standards applied by each adjudication organization can be refined,and the scope of cases can be rationally planned according to the different characteristics of each adjudication organization;the single-term system should be improved to the collegiate system.The standard for the conversion is to clarify the time node and approval procedures for the conversion from the sole-appointment system to the collegiate system;clarify the responsibility system of the collegiate panel,and promote the function of the collegiate panel by strengthening the responsibilities of other members of the collegial panel;improve the supervision system for single-person cases and clarify the courts In this process,the Chief Executive shall clarify the procedures and specific operations of the sole-appointment system of supervision,implement the supervision responsibilities and jointly advance these aspects,so as to solve the problems in the current application of the trial organization.
