Study On The Disposal Of Property Involved In Illegal Fund-raising Crimes

In recent years,with the rapid development of China’s financial market and the growth of private financing needs,illegal fund-raising crimes have also continued to be highly prevalent and have grown significantly,endangering China’s financial security,but also more so endangering all levels of China’s social and economic activities and undermining social stability.The disposal of property involved in illegal fund-raising crimes is not only an important issue,but also extremely complex,which involves a variety of judicial dilemmas,not only involving the intersection of criminal and civil and determining the participants of the fund-raising and other judicial procedures,but also about the punishment of crime and the protection of the legal rights of the parties and relevant interest groups.According to China’s criminal law and the numerous decrees and laws implemented by the central authorities since the 19 th National Congress,authoritative and mature regulations have been created on the handling of the property involved in the case.However,there are still some gaps in the laws and regulations relating to illegal fund raising crimes,and the implementation of the law is dependent on the joint response of the relevant judicial and law enforcement authorities and personnel,and the slightest deviation is not expected.With the financial disposition of illegal fundraising cases causing problems for the administration of justice,the alarm has been sounded that blind spots and loopholes in the legal framework cannot continue to be ignored.The question of how to rewrite such a situation has become a pressing one.In order to expose the judicial dilemma and causes of illegal fund-raising crimes in a more detailed and accurate manner,the author,adhering to the concept of unity of knowledge,has started from a large number of cases and made a scientific and systematic analysis around the disposal process of the property involved,pointing the spearhead at the shortcomings and weaknesses of the judicial mechanism and conceiving a mature and appropriate disposal path in order to contribute to the cause of justice.The first chapter is an overview,explaining the research on the disposal of property involved in illegal fund-raising crimes,and laying the foundation for the research on the disposal of property involved in illegal fund-raising crimes.The second chapter starts with empirical evidence and carefully selects some cases to analyse the loopholes and blind spots in the judicial model.The third chapter traces the root causes of the improper disposal of property involved in cases,and provides ideas for the following judicial dilemmas.The fourth chapter provides countermeasures and suggestions for improving the disposal of property involved in illegal fund-raising cases.
