Empirical Study On The Structure Of Environmental Code

The structure of the environmental code is mainly to arrange the various parts of the environmental law in a certain logical order to construct the style of the code.The codification of environmental law in China is deeply influenced by the European environmental code.Taking the structure of the environmental codes of France,Italy,Germany,and Sweden as research objects,it helps to rationally structure our environmental codes.In terms of environmental code codification,based on the current state of China’s environmental law and legislative conditions,it is more realistic to consider the substantive codification of the codification model of China’s environmental code.The mode of moderate codification between code and form codification is not easy to be too high.Regarding the adjustment content of the environmental code,China’s environmental code should focus on the overall benefits of the code structure.It should not be as large and comprehensive as the adjustment content of the French code,nor should it be as incomplete as the content of the Italian code.It should not omit natural protection,natural resources and resources.The necessary content in the field of pollution prevention and control can be expanded by abstracting it into general principles or regulations for the parts that are not easy to be incorporated into the code,paying attention to the reasonable connection with the one-way law.In the compilation of environmental code styles,China’s environmental code should consider the overall score structure,highlight the dominance of the general rules,play a guiding role in the division,and avoid falling into the weakness of the Italian code.The layout logic between the various parts can refer to the strict and uniform code structure of Germany to ensure the stability and systemicity of the code.The compilation of the environmental code in China is a continuous process.The relatively loose structure and the lack of content are inevitable.To this end,while maintaining the overall stability of the code,it can also have a certain degree of openness,leaving a pre-set mouth for content filling to avoid the disadvantages of the rigidity of the Code,that is,the dynamic arrangement of the structure of the Swedish Code,in order to improve the applicability of the Code.
