| Protecting the rights and interests of financial consumers is one of the important measures of financial reform.China has not yet formed a unified concept of financial consumers,and it lacks a system to cope with the new situations arising from mixed operations in finance.At the same time,the development of data technology has enhanced the ability of financial institutions to obtain information,making financial consumers and financial institutions asymmetric in information and disparity in transaction strength.As a result,it is difficult to protect the security of personal financial information.There is no unified personal information protection legislation in China.The current methods of incorporating personal information into the protection of privacy rights cannot fully protect financial consumers’ personal information rights.In addition,the rules for protecting personal information in laws such as the Consumer Rights Protection Act lack system and operability.In fact,the protection of personal financial information is the value of personal dignity and personal freedom,while the use of information is the embodiment of the value of information transfer.Therefore,the above interests need to be balanced.In practice,financial institutions utilize standard contracts to increase the obligations of financial consumers and exempt their own responsibilities.At the same time,due to the lack of specific obligations,financial institutions often use privacy policies to irregularly collect and use information.The violation of personal financial information is hard to be identified and the violation of rights is difficult to prove,which makes it difficult for financial consumers to protect their rights.To strengthen the protection of personal financial information,China should build a unified legal system for the protection of financial consumer rights,refine the obligations of financial institutions to protect personal financial information,standardize the content of format clauses in advance,and improve the methods of financial consumer rights protection. |
