Research On The Indigenization Of The Copyright Extended Collective Management System

Chinese Copyright Law has played an active role in protecting the legitimate rights and interests of copyright owners,stimulating their creative enthusiasm,promoting economic and technological development,and promoting cultural and artistic prosperity.At the same time,the development of economy,technology and culture and the deepening of reforms have also raised some new issues and requirements for the copyright protection system.And improving the collective copyright management system is an important issue in the third revision of the Copyright Law.In this revision,China has for the first time to explore the establishment of an extended collective management system for copyright,but the response has not been satisfactory,and it is in sharp contrast to foreign countries.Therefore,by tracing back the historical development of the extended collective management system,the paper researches the reasons for the implementation and the local resources in our country.Then,combining the legal relationship subjects and rights and obligations in the process of indigenization,although it is pointed out that different views are essentially based on different perspectives,it is undeniable that it’s a restriction of copyright.Therefore,if our country intends to establish the collective copyright management system,we must follow the private attribute of the Copyright Law and respond to the current challenges.Finally,we will lay a solid foundation of the copyright extended collective management system by reforming the management organizations,completing the supporting systems,and improving the marketability of the copyright collective management.
