On The Supervision Mechanism Of The National People’s Congress On The Disclosure Of Government Information

Because of the fluidity and usefulness of information in the information society,the rights of government information are widely distributed to unspecified citizens and organizations,even government organs;Based on whether it has the core of public service,the obligation subjects are relatively widely placed in administrative organs,institutions and enterprises providing public services.In addition to the existing ways of active disclosure and disclosure according to application,the government information disclosure should also be required to meet the needs of the supervision mechanism of the National People’s Congress.China’s government information disclosure system is in the transition from the traditional system to the right standard.It takes the right to know as the right carrier,highlights the importance of the public’s right to know,and effectively connects the functions and powers of the National People’s Congress in the state power system.In practice,the system of government information disclosure can not meet the higher requirements of people for information in today’s era.There are problems in the voluntary subject’s initiative to disclose government information,citizens’ application for disclosure of government information and the right protection mechanism.The government information that may involve crimes and local private interests is strictly blocked,The existing supervision and relief mechanism can not effectively solve these problems.The root of these problems lies in the fact that the people’s Congress does not give full play to the role of supervision,the public’s right to know is ignored,and the judgment of public interests is out of order.Therefore,the people’s Congress should give full play to its power in the constitutional system,effectively integrate multiple interests through representative democracy,form a democratic and scientific judgment of public interests,become a communication hub between the government and citizens,create a platform for the public to participate in government information disclosure,promote democratic participation and public opinion expression,and form an external supervision centered on the people’s Congress.The supervision mechanism of the National People’s Congress makes up for the deficiency of the original supervision and relief mechanism.It exercises the supervision power and provides relief for the government information disclosure affairs involving public interests,strictly controls the abuse of the government exemption and discretion,and expands the scope of government information disclosure.
