Problems And Solutions Of Criminal Law Application Of Environmental Pollution Crime

The crime of polluting the environment is a manifestation of the content of ecological environment protection in the criminal law,which is a vital part of our country’s criminal law,and also an indispensable part of environmental protection laws.With the deterioration of the global ecological environment,it is very important to play the role of criminal law in ecological environment protection.However,due to the late start and incomplete development of environmental pollution crimes in our country,various problems often arise in the application of criminal law,such as the difficulty of conviction of environmental pollution crimes,the low rate of criminal responsibility,the light penalties and so on.This paper creatively analyzes the causes of problems in the process of applying the criminal law of environmental pollution crimes from both internal and external aspects,considering not only the impact of the social environment,but also the defects of the legislation itself,and analyzing the problems more comprehensively and concretely.In order to better play the role of the criminal law in ecological environmental protection,given the problems in the application of the criminal law and the underlying reasons behind the crime of environmental pollution,we will strengthen ecological environmental protection,establish correct legislative concepts,and improve environmental pollution.Several aspects such as crime-related legislation and increased penalties have explored ways to solve problems,and creatively put forward the idea of incorporating the ecological environment restoration funds into punishment,to achieve the dual purpose of punishing criminals and environmental repair.At present,the crime of environmental pollution has not exerted its real value in the process of application of criminal law,the next step will actively promote the application of criminal law of environmental pollution and explore a better development paths,so that can really play its role as the most severe and compulsory law of human governance society.
