Study On The Protection Of Farmers’ Rights And Interests In The Withdrawal Of The Right To Use The Homestead

At present,China’s social security system is not perfect.Homestead bears farmers’ courtyard agricultural management,farmers’ living and living security,and low-cost lifestyle,which is regarded as the last survival security barrier by most farmers.Governments at all levels should follow the principles of"voluntariness" and "compensation" in promoting the withdrawal of homestead,so as to realize the farmers’living and working in peace and contentment.However,in the current process of the implementation of the increase and decrease of urban and rural construction land,as the main body of homestead withdrawal,farmers’ rights and interests have not been effectively protected,and the problem of rights and interests damage is widespread in the withdrawal of rural homestead promoted by local governments.At present,the issue of farmers’ rights and interests in the withdrawal of homestead in the context of the increase and decrease of urban and rural construction land has attracted great attention of the government,which has become the key to the development of new rural construction and urbanization in China.Therefore,the research on the protection of farmers’ rights and interests in the withdrawal of homestead is undoubtedly of great significance to the maintenance of farmers’ rights and interests,the stability of rural society,and the promotion of industrialization and urbanization.From the perspective of farmers’ economic rights,political rights and social rights,on the basis of previous studies,this paper uses the fuzzy evaluation method to analyze the changes of farmers’ rights and interests in the process of withdrawing the right to use the homestead.In the process of field survey in anninqu Town,Urumqi City,200 questionnaires were distributed,192 questionnaires were collected,14 unqualified questionnaires were eliminated,178 valid questionnaires were collected,and the effective rate of the questionnaire was 89%.Based on the field survey data of Anningqu Town,the index system is constructed from six aspects:family characteristics,economic status,housing status,security status,community status and psychological status,and the damage of farmers’ rights and interests is analyzed.The research shows that:because the government plays a leading role in the withdrawal of the right to use the homestead,the participation of farmers is low,and they often accept the arrangement passively,resulting in the direct damage to their rights and interests,and the economic status,security status,psychological status and other rights and interests of farmers have been damaged to a certain extent.After analysis,we find that the main reason lies in the weak position of the game between the farmers and the government and the imperfection of the current land property right system.In view of the above reasons,this paper puts forward relevant countermeasures and suggestions:improving the land development right system,changing the government functions and promoting the main position of farmers,providing some reference for the research of related fields and the solution of regional problems...
