Difficulties In Legal Governance Of Cyberspace Security

As the fifth space,the Internet space itself has the characteristics of borderless,hidden behavior,and combination of virtual and reality.To some extent,it over turns the boundary of geographical space in the traditional sense and connects people of all countries in the world closely.But on the other hand,we should also see that if we can not timely find network vulnerabilities and supervision,will also give criminals a chance to take advantage of.As the absolute liberalization of the Internet space is denied by the rapid expansion of the Internet space,there is no realistic basis for relying on the self-discipline of network users to clean up the Internet environment.On this basis,the legalization of the Internet space has a great necessity.The reform of this social mode of operation has brought shock and challenge to the traditional legal system,and at the same time has provided new opportunities and prospects for the reform of legal mode.Since China’s access to the Internet,it has been committed to Internet security governance.After more than 20 years of technological development,the comprehensive cyber space governance system has gradually become a system.General Secretary Xi Jinping proposed the "Internet power strategy" and it has become the top-level design of the country.At present,it has become a social consensus to further promote the Internet power strategy and implement the overall national security concept.Internet space transcends traditional national boundaries,and when it spirals out of control,no country can be left alone.There is no guarantee that individual countries can strengthen their domestic governance or prevent war between them.In view of this,Internet security as a sense of "common security" has become one of the most important issues for all countries.The huge economic and social value brought by the Internet has made all countries take a series of measures to maximize their own interests while maintaining the space security of the Internet.Therefore,there are bound to be differences in ideas.For example,developed countries such as the United States adhere to the "multi-stake holder governance model".They insist that the ideal good governance of cyber space should be based on the extensive participation and equal consultation of various actors.Developing countries,represented by China and Russia,believe that sovereignty in cyberspace should be respected,that each country should play a dominant role in cyberspace governance,and that global Internet governance should be made more just and equitable.Based on the characteristics of Internet space,this paper analyzes and compares the similarities and differences in the governance systems of China,the United States and Russia.It is found that there are differences in governance subjects,legal logic and governance concepts among different countries.However,there are also some commonalities,and their advanced governance practices do bring reference significance to the development of China’s Internet space governance.This paper focuses on the analysis of the current situation of the development of China’s Internet space and the problems existing in the space security governance,in-depth exploration of the whole process of the implementation of the "Cyber Security Law".It is found that although the governance system has been basically improved,there are still some problems,such as insufficient key information infrastructure,low degree of domestic and foreign joint participation in governance,poor effect of top-level design regulation and weak supervision of illegal behaviors.Therefore,according to the current weak links,this paper puts forward the following suggestions:First,continue to consolidate and develop the construction of information infrastructure,especially do a good job in the construction of CNNIC and new infrastructure projects;Second,we should up hold the vision of building a community with a shared future in cyberspace,and enhance the capability of comprehensive cyberspace governance.Third,we should weaken the administrative color of top-level design and maintain the unity,coordination and foresight of legislation.Fourth,strict construction of law enforcement team,with high-quality,efficient law enforcement super vision team to promote the clear and bright development of cyberspace.
