Research On Bankruptcy And Exit Of Farmers’ Professional Cooperative "Shell Society"

With the deepening of the supply-side structural reform,the perfect market exit mechanism of "Shell Society" is conducive to the modernization of agriculture and rural areas and the strategy of rural revitalization.In order to rectify and rectify the exit of market players corresponding to the access and survival of market players,which is the biggest institutional weakness for optimizing the business environment,the institutional value of bankruptcy is receiving unprecedented attention,which can effectively drive the market-oriented and law-based exit of "Shell Society".However,although the Civil Code of the People’s Republic of China has provided the market access regulation and the Law of the People’s Republic of China on Farmers’ Professional Cooperatives,it still lacks the indispensable bankruptcy regulation,which leads to the problem of blocking the bankruptcy exit channel of the "Shell Society".At present,the outbreak of the chaos of "Shell Society" can be described as "blowout",which makes its harm unceasingly aggravate,and relying on the policy exit advocated vigorously in recent years can only "stop the soup from boiling" effect,so focusing on the bankruptcy exit should be imperative.Examining from the perspective of business legal person,from the perspective of "property + people + procedure",the bankruptcy of "Shell Society" mainly has the outstanding predicament,such as the vague definition of bankruptcy property,the incomplete regulation of bankruptcy administrator,the obstruction of the application of bankruptcy procedure.Based on this,this paper focuses on the "trinity" construction of clear bankruptcy property,strengthen the regulation of bankruptcy administrator,optimize the application of bankruptcy procedure,and so on,in order to effectively realize the market exit of "Shell Society".This paper is divided into six parts,focusing on the bankruptcy feasibility analysis of "Shell Society" and the bankruptcy system construction.The first part is the introduction.This part defines the topic of this paper,introduces the research background,research significance and research summary inside and outside the field,briefly explains the important and difficult points,and finally puts forward the research key and the main innovation.The second part is the basic understanding of "Shell Society".This part differentiates the related concepts of "Shell Society",combs the main harm of "Shell Society",compares the difference between adjacent subjects,and lays the foundation for the discussion of "Shell Society" bankruptcy exit.The third part is the feasibility of "Shell Society" bankruptcy application.This part mainly analyzes the feasibility of "Shell Society" bankruptcy application from the basis of commercial law,theoretical disputes,policy reform,and clears away the cognitive and qualification obstacles for further analysis of "Shell Society" bankruptcy exit system.The fourth part is the legal dilemmas of "Shell Society" bankruptcy exit.This part inspects the bankruptcy system,mainly reveals the outstanding dilemmas of "Shell Society" such as the vague definition of bankruptcy property,the incomplete regulation of bankruptcy administrator,and the obstruction of the application of bankruptcy procedure,so as to show the strong demand for the improvement of the bankruptcy exit system of "Shell Society".The fifth part is the improvement of the bankruptcy exit system of "Shell Society".This section,as the core of this study,concentrates on the "three-in-one" improvement measures,i.e.clarifying the identification of bankruptcy property,strengthening the regulation of bankruptcy administrators and optimizing the application of bankruptcy procedures,with a view to building a set of effective bankruptcy improvement systems based on the correspondence of "property +personnel + procedure".The sixth part is the conclusion.In this part,the author summarizes the main arguments and the important conclusions,highlighting the significance of constructing market-oriented and legal bankruptcy withdrawal to ease the difficult problem of "Shell Society".
