| In 2010,China officially began to implement the social rescue fund(SRF)system for road traffic accidents.The establishment of this system is to close the loopholes in the compulsory liability insurance system.It is a supplement to the compulsory traffic accident liability insurance system for motor vehicles,and aims to guarantee that victims in road traffic accidents could receive timely treat mentor appropriate compensation with the assistance of rescue funds if they cannot receive compensation from the infringers in accordance with the compulsory traffic accident liability insurance system for motor vehicles.As a new form of social rescue,the establishment of the SRF system for road traffic accidents has played a positive role in protecting the rights and interests of victims in motor vehicle accidents,risk sharing of traffic accidents,and promoting social harmony.Dalian,as a city specifically designated in the state plan,officially implemented the"Temporary Administration Measures for the Social Rescue Fund for Road Traffic Accidents in Dalian" on January 1,2018.During the two years of implementation,it has acquired certain social benefits,but there still exist the problems of rescue fund redundancy and a certain number of victims in motor vehicle accidents cannot receive effective assistances.Hence,the system is far from fully exerting its functions.This paper takes the development of the SRF system for road traffic accidents in Dalian as the research object,adopts the combined method of theoretical and applied researches,and uses relevant theories of public management and social security to carry out related research.In the first part,we focus on countries and cities with better development of the system,including foreign countries such as Britain,Germany and Japan,and domestic cities such as Guangzhou,Shanghai and Nanjing.The paper analyzes and compares the status quo of the development of the system in the above mentioned cities,discusses their achievements and experience,and studies its development direction.In the second part,we analyze the formulation of Dalian government policies and regulations and the implementation of government functions.Taking the urban development of Dalian into consideration,we summarize the problems faced in actual operations.The establishment of the system in Dalian has not been long.During the implementation,problems occurred,such as the incomplete content of the SRF for road traffic accidents,their rationality of the management mechanism,the weak executive functioning,and the lack of supervision mechanism.The author hopes to solve these problems as the starting point,to study and analyze the problems found,trace the root causes of the problems,find solutions to the problems,and put forward effective solutions point to point.The paper offers more reasonable suggestions to improve the development of SRF system for road traffic accidents in Dalian,by further improving the content,re-planning and integrating their management department settings,constructing the reasonable implementation mechanism,and establishing the comprehensive supervision system. |
