Study On Prosecutorial Suggestion On Social Affairs

Prosecutorial suggestion on social affairs is a proposal for improving work and govemance made by procuratorial organs in response to the need to eliminate hidden dangers of crime,loopholes in management and supervision,improve early waming and preventive measures for risks,and give administrative punishment.administrative sanctions and industrial discipline to relevant personnel or organizations,with non-litigious,consultative,non-compulsory and active characteristics.From the beginning of the New Democratic Revolution,prosecutorial proposals of social govemance nature began to appear in China and played a positive role in social govermance although developing d ifficultly.And social govemance prosecutorial suggestion has been officially defined as one of the categories of prosecutorial suggestion by the Provisions on Prosecutorial suggestion of the People’s Procuratorates in 2019.The Supreme People’s Procuratorate has been making efforts to promote the development of social govemance procuratorial suggestions,and although the work has begun to bear fruit.With the number of social govemance procuratorial suggestions issued,the response rate and the adoption rate all improving,ananalysis of the current situation reveals that it still suffers from unscientific legislation,non-awareness,inadequate implementation,and a lack of rigidity,which needs to be improved by improving legislation,deepening the understanding of the system,putting the system in place,clarifying intemal prosecutorial instruments and improving rigidity,in order to answer questions about what social govemance prosecutorial suggestion is and what it does,and discuss how to improve prosecutorial suggestion according to the logic of “planningimplementation-effect”,in order to throw a sprat to catch a herring.
