At present,different countries still operate different implementation mechanisms of settlement agreements,which is difficult to form unified standards,and the implementation barriers between countries still exist.Therefore,the implementation of international commercial settlement agreements arising from commercial mediation has been blocked.Therefore,most parties are unwilling to choose international mediation as a way to solve disputes,and turn more to international litigation and international arbitration.The introduction of the Singapore convention has also greatly improved the current situation.It is an innovation of the global commercial dispute settlement system,promotes the wide application of mediation in international commercial dispute settlement,and actively promotes the international commercial mediation system to become a national commercial dispute settlement method widely recognized by the world after national judicial judgment and arbitration,Open up a new situation of international commercial dispute settlement.China has now signed the Singapore Convention,and its ratification is just around the corner.This paper mainly analyzes and studies the current situation of China’s commercial mediation system and the connection between China’s legal system and its ratification of the Singapore Convention.Through the analysis of the core content of the Singapore Convention,the necessity of China’s ratification of the Convention and the dilemma after the connection were discussed,and suggestions for responding after the ratification of the Singapore Convention were put forward,contributing to the maturity of China’s legal system of commercial mediation.The main content of this paper is divided into three parts.The first part summarizes the provisions of the Singapore Convention and China’s current commercial mediation system.The second part analyzes the possible impact of China’s ratification of the Singapore convention.From the legislative and judicial aspects,this paper expounds the challenges that China may face if it ratifies the Singapore convention.The third part puts forward corresponding suggestions on the lack of China’s current commercial mediation system.This chapter aims to provide suggestions for China to establish an independent legal system of commercial mediation that is more closely connected with the Singapore convention.This paper puts forward suggestions from the two aspects of formulating and improving the applicable supporting legislation in China and establishing the corresponding judicial connection system,so as to promote the legalization process of legislation and judicature in the aspect of the Singapore convention.
