Research On Data Privacy Infringement On Internet Platforms

In recent years,with the deepening development of digital economy,data privacy protection has become an inescapable topic in the process of Internet development.This paper discusses the concept of "data privacy" for the first time,defines the data privacy of users from the perspective of personality rights,and discusses several modes of protection.This paper focuses on some new situations in the practice of Internet applications in the era of big data.Specifically,it describes some new problems of platforms in the collection and utilization of user data and analyzes the specific causes of platform infringement on user data privacy.Through the study of data privacy infringements themselves,it is found that some infringements are clearly illegal in form and can be easily identified.Some infringements are almost flawless in procedure and form,however,the corresponding decisions made by using such information do violate the legal rights of citizens.This paper synthesizes the theoretical research results of academia and uses the institutional tools of tort liability to analyze the constitutive elements of platform data privacy infringement.From the perspective of tort liability law,we analyze the platform data privacy infringement itself,and clarify the characterization,infringement subject,object and related responsibilities of the relevant responsible parties for user data privacy infringement by analyzing the types and constitutive elements of data privacy infringement.At the same time,it compares the relevant legislative models and protection measures of countries and regions that are at the forefront of data privacy protection in the world today with those of China,and points out the achievements and shortcomings of China.It provides ideas for further improvement of legislation and protection of user data privacy and regulation of platforms.
