Legislative Perfection Of The Legal Officer System Of Public Security Organs

In 2000,the Ministry of Public Security first proposed to establish the position of 1 egal officer.In 2010,the Ministry of Public Security officially issued the Opinions of the Ministry of Public Security on Establishing the Legal Officer System in County Public Security Organs（hereinafter referred to as the Opinions）,which clearly established the legal officer system.The author reviews the tortuous development of the legal officer system of public security organs in China,and finds that the legal officer system has become a major guarantee for the internal supervision of law enforcement of public security organs.However,due to the imperfect legislation of the legal system of public security organs in China,there are still a series of problems to be solved in the concrete implementation process of the legal system.Therefore,in the important period of China’s construction planning under the rule of law,based on China’s basic national conditions,we should study the practice of local public security organs,insist on legislation first,ensure the quality of legislation,and improve the legislation of the legal system of public security organs.From the perspective of administrative law,this paper explores the basic theory and present situation of the legal officer system in public security organs in China,taking the development of the legal officer system as a clue.This paper analyzes the problems existing in the legislation of the legal officer system of public security organs in China,such as low legislative rank,different local standards and imperfect legislative supporting system.Through the study of similar systems in China,we find useful experiences,and summarize and analyze the reference significance of relevant systems to the legislative perfection of the legal officer system in public security organs;Through careful combing and rigorous analysis,aiming at the problems existing in the legislation of the legal officer system of public security organs in China,and relying on the important background of the construction of the rule of law in China,this paper puts forward some suggestions on the legislative perfection of the legal officer system of public security organs,including establishing the basic legislative principles,improving the national legislative rank,unifying the local regulations and other specific measures.In order to establish a scientific and perfect legal system and deepen the standardization of public security law enforcement.
