On Case Generation Standard In Similar Cases Searching System

On August 1,2017,the Supreme People’s Court issued the Opinions of the Supreme People’s Court on the Implementation of the Judicial Responsibility System（Trial）,which stipulated in Article 39 that judges in charge of handling cases should“make searching reports of similar cases and related cases”,marking the emergence of the similar case searching system.It has been more than four years since the system was first put forward.The Supreme People’s Court and courts at all levels have issued implementation norms.There have been a lot of practice of similar cases searching in the adjudication,and many problems have been exposed in the practice.Kind of cases searching system implementation depends on two aspects,one is a sample case quality content and standardized format,the second is the big data technology to accurate grab similar case,so the problem of standardization of case study in how to generate will have important significance for the implementation of the similar cases searching system.This paper first briefly introduces the development and specific application methods of the searching system,and then summarizes several kinds of problems still exist in the system,among which the problem of case generation is the main problem.About the kind of case searching system combining case,the method in detail,such as combing the current situation of the case generated summarizing problems in case generated,and then extract the standardization of case generated shall conform to the requirements.According to the investigation and study content to the problems that should be how to improve the quality of case generated,from the essence and formally put forward concrete suggestions combining supporting system.The purpose of this paper is to promote the implementation of the similar case searching system.
