| The improvement of the level of Internet information technology has promoted the development of the e-commerce industry.However,in recent years,the e-commerce industry has shown a declining trend,resulting in a large number of violations of laws and regulations.In the face of these problems,the state has begun to increase the supervision of the e-commerce industry,and has set up a number of regulatory obligations for e-commerce platform operators through legislation,making them responsible for supervising e-commerce activities on the platform and managing related issues on the platform.Regulatory obligations to ease the regulatory burden outside the government.However,due to the current legislation on regulatory obligations,there are still problems such as ambiguous regulatory content,formalized legal provisions,and unreasonable setting of regulatory obligations.As a result,some regulatory obligation legislations have not only failed to achieve the expected results during the implementation process,but have hindered the development of the e-commerce industry.Therefore,it is necessary to conduct in-depth research on the validity of the current legislation on regulatory obligations to find out its existing problems and make suggestions for improvement.By sorting out the legal provisions on the supervision obligations of e-commerce platform operators in my country,it can be found that there are great differences in the legislation of supervision obligations in different periods,but the legislation of supervision obligations is improving day by day on the whole,with obvious problems pertinence,stages and integrity.The current legal provisions on supervisory obligations have the following characteristics: the regulation of supervisory obligations is dominated by imperative norms and supplemented by prohibitive norms;the supervisory obligation system is gradually improved and the content is continuously refined;the scope of supervisory obligations basically covers the e-commerce industry.The existing problems and the complete stage of e-commerce activities;the setting of regulatory obligations overemphasizes the fulfillment of obligations and legal responsibilities,ignoring and weakening the actual regulatory capabilities and regulatory differences of e-commerce platform operators.At the same time,according to the types of problems involved in e-commerce activities,the objects of supervision and the stages of e-commerce activities,the supervision obligations set by the current legislation can be divided into types,so as to further study their specific content.In addition,from the perspective of the content setting of regulatory obligations,the current development status of the e-commerce industry also has an impact on the legislation of regulatory obligations.By analyzing the implementation of the legislation on regulatory obligations,it can be found that there are still differences in the specific implementation of the current legal norms for regulatory obligations.Among them,some laws and regulations on supervision obligations are well implemented,but there are also many laws and regulations on supervision obligations that are mere formalities,unimplemented and difficult to implement in the process of implementation.By analyzing the reasons for these implementation situations,it can be found that there is a strong connection with the legislative issues of current regulatory obligations.These problems include: flaws in the concept and rules of the legal norms of regulatory obligations;lack of differences in the setting of regulatory obligations and excessive strictness;unclear and unreasonable legal responsibilities for violation of the legal norms of regulatory obligations.In response to the above problems,this paper puts forward the following suggestions for the improvement of the supervision obligation legislation: First,improve the elements of the legal norms of supervision obligations.The second is to precisely set the regulatory obligations of e-commerce platform operators.The third is to reasonably allocate the legal responsibility of e-commerce platform operators for violating regulatory obligations and norms.By making these suggestions,it is hoped that the future legislation on regulatory obligations can be further improved. |
