In terms of the relationship between the central and local governments,the most important thing is the division of legislative authority between the central and local governments,which not only affects the unity of the country,the unity of the nation and the stability of the society,but also relates to the promotion of the efficient and scientific operation of the whole national management mechanism.However,the current system of division of legislative authority between central and local governments in China does not match the increasingly complex social needs,and there are still some problems in the division of legislative authority in practice,such as fuzzy boundaries.Therefore,the author hopes to further improve the central and local legislative power division in China by exploring the actual operation of the system.The body of this article includes the following contents:The first part is an overview of the division of central and local legislative powers in China,including the theoretical basis of central and local legislative powers and the timeline of the development of central and local legislative powers in China.By interpreting the concepts of "central legislation" and "legislative authority",this paper introduces the basic theoretical knowledge of the division of central and local legislative authority,such as mode,standard,method and internal structure,which lays a theoretical foundation for this paper.The second part is an empirical study of the vertical development of central and local legislative power divisions in China.This part takes 1954 and 1979 as the time nodes,divides the development of central and local legislative power division into decentralized legislation,central centralized legislation and stratified legislation periods,and investigates the development characteristics,historical background and legislative situation of each period.The third part mainly investigates the current situation of the division of legislative power between central and local governments in China.The division of central and local legislative authority in China is not only different from the western federal system countries,but also different from other unitary system countries.After years of exploration,China has formed a diversified classification standards and legislative pattern,rich internal composition of legislative authority and power source forms,which are Chinese characteristics.But at the same time,behind these appearances,there are also hidden problems such as the formation of central and local legislative authority,the division of legislative authority and administration.The fourth part puts forward suggestions on optimizing the division of central and local legislative powers between macro and micro levels.Although the current system of central and local legislative power division in China is inadequate,it still has some reasonable points,so it is not advisable to take drastic measures in the process of improvement,and we should adhere to the overall pattern of gradual improvement on the premise of not changing.
