Study Of The Rules Of The Admissibility Of Civil Electronic Evidence

With the appearance of internet court,the application of the technology of storing evidence,and the gradual deepening awareness of civil electronic evidence,a series of relevant legislation and judicial interpretations have been promulgated to provide legislative guidance for the admissibility of civil electronic evidence.However,the rules of the admissibility of civil electronic evidence are still relatively general and ambiguous and are confronted with the problems in application.To be concrete,the admissibility is difficult to identify,the relevancy of carriers is not paid enough attention,and it is difficult to identify the original.All of these problems make its application in judicial practice undesirable.Therefore,it is necessary to combine with the judicial practice in China,to specify the rules of identifying the legitimacy,relevancy,authenticity of civil electronic evidence,to further improve the rules of the subjects of collecting civil electronic evidence and relevant procedures,to emphasize the relevancy of the carriers of civil electronic evidence,and to define the scope of the authenticity of civil electronic evidence.Meanwhile,the rules of identifying the integrity of civil electronic evidence and the original so as to be adapt to the demand of current judicial practice.The study of the rules of the admissibility of civil electronic evidence is advantageous to be adaptable to the new features of electronic evidence.It can make the identification of civil electronic evidence more accurate,quick in judicial practice.In addition,it can improve the judicial quality and effect better and provide the guarantee of system for making the stable,highly efficient operation of the judicial practice of civil litigation in China.
