| Legal consciousness studies concerning the legal consciousness of the grassroots people have always been an issue of concern to the academic community.As a grassroots society,the legal awareness of pastoralists can be regarded as a microcosm of the legal awareness of the grassroots people in China.In order to show the legal consciousness of herders,taking the environmental dispute settlement in the pastoral areas of Xilinguole league as the entry point,we use field research and case study methods to conduct a legal-sociological investigation into the pastoral environmental disputes,the current situation of dispute settlement as well as the action strategies and discourse strategies of herders,and use Sally Engle Merry’s theoretical framework of legal consciousness to refine the way herders use and understand administrative power,judicial power and law,in an attempt to elucidate the social environment and personal experiences shape the legal consciousness of pastoralists,who have a complex and diverse legal consciousness of following,creating,using and confronting the law. |
