| Functional theory holds that the components of a system or an organization are functionally interrelated and inseparable,and active functions contribute to the survival and operation of the system.The theory of organizational goals holds that only when a system or an organization focuses on its sole goal can it give full play to its due efficiency.Therefore,from the perspective of functional theory,this thesis focuses on analyzing the differences and similarities between the functions of inner-Party regulations and state laws,providing a basic theoretical perspective for the convergence practice of inner-Party regulations and state laws.From the perspective of function,we can not only study the classification of the two from the basic theory of function,but also analyze the connection between intra-party regulations and national laws by understanding the specific contents of the powers and duties of the ruling party and the legislature.As subsystems in the system of socialist rule of law with Chinese characteristics,they give full play to their "functions" in their own fields,which is conducive to the improvement and development of the upper system.The convergence mode of inner-party regulations and national laws is different from that of western countries,which are mainly unified and dispersed,while China has formed a collaborative convergence mode due to the differences of ideology and party system.In the collaborative cohesive mode,it is further divided into direct and indirect cohesive modes.The direct connection is mainly analyzed from the aspects of adjustment scope and formulation subject.Indirect cohesion focuses on the study of the cohesion between the two media.Therefore,to deal with the connection between the two is the key to realize the overall goal of governing the country by law,and the internal motivation to promote the rule of law at the national governance level and the party governance level. |
