Environmental Civil Public Interest Litigation System Research

In the context of the continuous improvement of Chinese social economy,the country's comprehensive national strength has reached a new height in the international community,but at the moment,the problem of environmental pollution is becoming more and more serious,which is an important issue that cannot be ignored in the process of economic development.The preamble of Chinese constitution states that in the process of building a powerful modern socialist country,the construction of ecological civilization is an important part of Chinese development.This shows the importance of current environmental protection issues.The Civil Procedure Law revised in 2012 pointed out that the protection of environmental pollution is strengthened through civil law,and civil public interest litigation plays an important role in combating environmental pollution.In 2020,the Supreme People's Court made further detailed explanations on environmental civil public interest litigation,which once again emphasized the importance of civil public interest litigation.However,the current environmental civil public interest litigation system in China still needs to be further improved in the implementation process.The narrow scope of the subject qualifications,the high litigation costs in the litigation,and the lack of a professional jury system for the highly specialized environmental pollution problem are all urgent issues.The perfect part needs to be done.Therefore,by expounding the relevant theories of the environmental civil public interest litigation system,the paper compares and analyzes the representative environmental civil public interest litigation systems in civil law countries and common law countries,and summarizes the enlightenment of the extraterritorial related systems to Chinese environmental civil public interest litigation system.At the moment,the paper analyzes the subject qualifications of plaintiffs,litigation costs,related jury systems and other issues from the current situation of Chinese current environmental civil public interest litigation system,puts forward suggestions for improvement.
