"Yu Huan case" that occurred in 2017 has fueled arguments among people in that Yu Huan's punishment of life imprisonment was commuted to fixed-term imprisonment of five years.From the criminal justice perspective,it's a matter of the legal facts and trial in accordance with the law.But from discourse,it's about the construction of Yu Huan's discursive identity.In light of that,this thesis attempts to apply pragmatic theories to a contrastive study of Yu Huan's identity construction process finding out how Yu Huan's identities are constructed in written judgments and media reports and what are their similarities and differences.Based on Verschueren's "Linguistic Adaptation Theory" and Chen Xinren's "Pragmatic Identity Theory",the thesis puts forward a pragmatic analysis framework of dynamic adaptability of narrative discourse identity construction in the written judgments and media reports.Through comparative analysis,it can be seen that there are great differences between the construction of Huan's identity made by judges and media reporters,namely,the types of Yu Huan's identity and the choice of discourse strategies under specific communicative purposes and specific contextual constraints.This thesis focuses on the types and discourse strategies of Yu Huan's identity construction in judgments and media reports,and concentrates on the adaptation characteristics behind Yu Huan's identity construction.Based on the comparative analysis,this thesis reveals the similarities and differences between written judgments and media reports,which may contribute to our understanding of the generic features and persuading “art” of judgments and media reports and our appreciation of the “pragmatic effect” of Yu Huan's identity construction in judicial and media context.Meanwhile,this thesis will enhance the audience's awareness and ability to better understand written judgments and media reports,and then promote the realization of positive interaction between justice and public opinion.
