Participation In The Distribution System Research In Civil Enforcement

With the rapid development of China’s social economy,economic disputes have increased rapidly.In civil execution,it happens a lot case that the same debtor corresponds to multiple creditors.Because the debtor’s limited assets are not sufficient to pay off all debts,some debts cannot be paid off.To a certain extent,the problem of "difficulty of execution" has been exacerbated.In order for creditors under this situation to be compensated fairly,participation in distribution system is essential.At present,the legislation and construction of China’s participation in distribution system are not perfect,and many issues have not been clarified,which has caused difficulties in application.By sorting out the concept of participation in distribution,this paper studies the function and value orientation of participation in distribution system,summarizes the current legislation of the participation in distribution system in China,analyzes the problems and contradictions of the system in practice,and draws on the experience and practices of countries and the advanced theories of the academic community.Finally put forward suggestions on the establishment of China’s participation in distribution system from the application subject,time node,procedure setting,relief channels,etc.,hoping to contribute a little to the research and legislation of China’s participation in distribution.
