With the development of social economy,a series of new problems such as yin-yang contracts,inconsistent contracts and black-and-white contracts have appeared in economic activities.These issues are related to the scheme of conspiracy to act falsely.Paragraph 1 of Article 146 of the General Principles of Civil Law stipulates that the conspiracy to hypocrisy is invalid,but its content is too thin to cover the issues related to conspiracy to hypocrisy in society.The law does not clearly stipulate the effects of conspiracy to hypocrisy on the effectiveness of third parties,the effectiveness of registered conspiracy to hypocrisy,the effectiveness of conspiracy to hypocrisy related to identity behavior,and the cooperation between conspiracy to hypocrisy and fraud of one party.The academic circles have been controversial about the definition of conspiracy to hypocrisy and the effectiveness of conspiracy to hypocrisy.This article analyzes the conspiracy hypocrisy in China’s legislation by combining typical cases with the concept of conspiracy hypocrisy,the elements of conspiracy hypocrisy,the difference between conspiracy hypocrisy and similar systems,and the legal effect of conspiracy hypocrisy Inadequacy of the behavior system.From the perspective of the definition of conspiracy and hypocrisy,the protection of bona fide third parties in conspiracy and hypocrisy,the effectiveness of registered conspiracy and hypocrisy,the conspiracy and conspiracy of conspiracy and hypocrisy to collaborate with one party’s fraud,etc.,we put forward suggestions for improvement.
