Research On Civil Execution Difficulties

"Difficult to civil enforcement " is not only an urgent legal problem,but also an inevitable social problem.Although the problem of "difficulty in enforcement" has been improved to some extent,there is still a distance from "resolving the difficulty of enforcement".The long-term existence of difficult enforcement issues not only damages the lawful rights and interests of the parties involved in the case,but also weakens the judicial authority and negatively affects the healthy operation of society.The article conducts research on the difficult problems of enforcement from three aspects: the status quo,causes and solutions.From the perspective of statistical data and actual performance,a comprehensive analysis of the current status of enforcement difficulties.On this basis,trace the causes of difficult implementation problems.The lack of integrity consciousness and the concept of the rule of law,the lagging civil execution legislation and the imperfect execution management system have resulted in difficulties in execution.Based on the experience of relevant systems outside the region and the actual situation in China,the article proposes practical solutions from the aspects of enforcing individual legislation,advancing the implementation of system reform,and improving the relevant assistance mechanisms that assist enforcement.
